印度对中国铝箔反倾销日落复审立案要点
1. 申请人：
印度三家生产企业： Hindalco Industries Ltd., Raviraj Foils Ltd.及Jindal India Ltd.。另外，印度Green Berry FoilsIndia Ltd对发起反倾销日落复审表示支持。

英文产品描述：
Aluminium Foil whether or not printed or backed withpaper, paper board, plastics or similar packing materials of a thicknessranging from 5.5 micron to 80 micron.

i. Aluminums foil of thicknessranging from 5.5 micron to 80 micro-originating in China.
ii. Alu Alu Laminate: Alu AluLaminate of 40 – 50 mic in AA8079 & AA8021, is a multilayered opaquelaminate where Aluminium foil and is backed with plastic film on both side withadhesives; for use in packing capsules/tablets.
iii. Ultra-Light GaugeConverted: Ultra-Light Gauge Converted is an aluminium foil having thickness of5.5 mic to 7 mic which is backed with kraft paper & scrim, or glass cloth,whether plain or printed for use in insulation, spices packing, thermal fluidlines covering and tea bags application.
iv. Aluminium Foil Composite:Aluminium foil laminated with or backed with Kraft paper and glass scrim orglass cloth with or without poly ethylene, whether printed or not printed. Aluminiumfoil laminated with or backed with Kraft paper however is within the scope ofthe product under consideration and proposed measures.
v. Aluminum foil forcapacitors width below 500 mm: Aluminum foil for capacitors is an Aluminum foilof 5-micron gauge with width below 500 mm 99.35% purity, for use in electricalequipment such as radios, televisions, telephones, computers, microwave ovens, electricalwelders, magnetos, electronic testing equipment, copy machines, airconditioners, automobiles, fluorescent lights, mercury vapour street lamps,power transmission equipment, electric motors, control units, and similararticles.
vi. Etched or formed AluminiumFoils: Etched or formed Aluminium Foils is Aluminium Foil meant to be used inthe manufacture of Electrolytic Capacitor.
vii. Aluminium compositepanel: Aluminium composite panel is a non-aluminium core (often PE) bondedbetween two thin layers of aluminium, for use in facade cladding and signage.
viii. Clad with compatible nonclad Aluminium Foil: Clad with compatible non clad Aluminium Foil is acorrosion-resistant Aluminium sheet formed from Aluminium surface layers metallurgicallybonded to high-strength Aluminium alloy core material for use in engine coolingand air conditioner systems in automotive industry; such as radiator,condenser, evaporator, intercooler, oil cooler and heater.
ix. Aluminium Foil for beerbottle: Aluminium Foil of 10.5 micron with rough surface and perforated whetherprinted or not; to be used in beer bottle.
x. Aluminium- Manganese-Silicon based and/ or clad Aluminium- Manganese- Silicon based alloys, whetherclad or unclad: with post brazing yield strength greater than 35 MPA, falling undertariff heading 7607 for use in heat exchangers including radiators, charge aircoolers, condensers, oil coolers, heater cores, evaporators, heat ventilationand air conditioning (HVAC) systems and parts thereof.

5. 产品编码（分类）规则：
本案申请人主张将被调查产品分为两类，一类为光箔（Bare foil），一类为有衬背铝箔（Converted foil），如下：
各利害关系方对产品编码编码（分类规则）如有其它补充和建议，应在立案公告发布15日内向调查机关提出。
6. 调查期：
倾销调查期（POI）： 2020年4月1日至2021年3月31日
损害调查期：2017-2018年，2018-2019年，2019-2020年及POI
7. 倾销幅度：
为了在立案申请阶段证明存在倾销，申请人以欧盟对印度的出口价格作为确定“正常价值”的依据。
中国对印度的出口价格是在商业情报和统计局（DGCI&S）的进口交易数据基础上，对海运费、海运保险费、港口费用、银行费用、装卸费和佣金进行了调整后计算出来的。
申请人称正常价值高于中国对印度的出口价格，因此存在倾销，但没有披露其计算出的倾销幅度。
调查开始后，调查机关将另行确定计算正常价值的方法并具体计算各应诉企业倾销幅度和整体的损害幅度。
根据印度反倾销日落复审实践，日落复审不仅决定是否延长原有反倾销措施，同时也可调整反倾销税率。无论企业是否参与过原审调查均不影响（或代替）此次日落复审调查，因此上述调查期内有对印度出口的企业应高度重视此次复审调查，以确保合作地位，避免惩罚性税率。
8. 立案的决定
调查机关认为申请人提交的申请书已经包含初步证据，证明存在中国产品继续或重新对印度倾销的情况，因此决定启动日落复审调查。
调查范围将与原审一样，调查机关将就反倾销调查的各相关问题进行调查并做出裁决，包括就倾销和损害的可能性的分析。
9. 时限：
各应诉企业需在收到调查机关的通知函后30日内提交完整答卷。
